These Terms of Service govern your use of the website located at usjalert.com (the “Service”) operated by Towerdock Pty Ltd ("Company", "we", "us", or "our").

By accessing usjalert.com, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from using or accessing this website or using any other services provided by us. The Service is a web app only (no mobile app).

We reserve the right to review and amend these Terms of Service at our sole discretion. Upon doing so, we will update this page. The version published on this page is the most current version. Any changes take effect immediately from the date of publication. By continuing to use the Service after changes are published, you agree to the updated Terms.

No Affiliation With Universal Parties

USJ Alert is an independent service operated by the Company. We are not affiliated with, endorsed by, sponsored by, or approved by Universal Studios Japan (USJ), Universal Studios, Universal Destinations & Experiences, NBCUniversal, or any of their parents, subsidiaries, or affiliates (together, the "Universal Parties"). All trademarks and brand names belong to their respective owners.

What USJ Alert Does (and Doesn’t Do)

USJ Alert monitors third-party ticketing systems and sends alerts when our systems detect availability at a point in time. We do not sell tickets, reserve inventory, or complete purchases. We are not affiliated with, endorsed by, or sponsored by the operators of the ticketing systems we monitor.

Alerts, Timing, and Third-Party Dependencies

An alert means “availability was detected” at a specific moment - not that tickets are still available, purchasable, or will remain available. Availability can disappear in seconds or minutes. Alerts are best-effort and depend on third-party systems and delivery networks we do not control. We do not guarantee continuous monitoring, real-time delivery, uptime, or any particular outcome. We do not guarantee you will be able to check out or successfully purchase tickets, even if you receive an alert.

Notifications

If you enable notifications, you agree to receive alerts by the channels you select (for example, email and/or SMS). Notification volume varies and depends on what our systems detect and on third-party systems.

You may receive zero alerts, and you may receive alerts that are delayed, duplicated, or not delivered due to factors outside our control (for example, email providers, mobile carriers, device settings, spam filtering, outages, or network conditions).

Fees and What You’re Paying For

Payments are processed via Stripe. If the Service requires payment, the fee is for access to monitoring and alerts - not for any guarantee of ticket availability or successful purchase.

Unless we clearly say otherwise at checkout, access is a one-time purchase (not a subscription). If you change your selection in a way that increases the price (for example, adding an earlier date), you may need to make an additional one-time payment for the difference.

Payment issues and chargebacks

If a payment fails, is reversed, or is charged back, we may cancel or suspend your access to the Service and associated alerts. You are responsible for any fees or charges imposed by your bank or card issuer.

Refunds

Except where required by law (including the Australian Consumer Law), fees are generally non-refundable. We may offer a refund or credit at our discretion unless we have explicitly promised a refund in writing.

Support

Support is online-only and asynchronous (best-effort). We do not provide real-time support, phone support, or an SLA.

Eligibility

You must be at least 18 years old to use the Service.

Account Security

You are responsible for maintaining the confidentiality and security of your account and for activity that occurs under your account. Notify us promptly if you believe your account has been compromised or used without your permission.

Service Changes and Availability

We may change, suspend, or discontinue the Service (in whole or in part) at any time. We may also restrict access to parts of the Service for security, operational, or legal reasons. We are not responsible if the Service is unavailable at any time.

Limitations of Use

By using this website, you warrant on behalf of yourself, your users, and other parties you represent that you will not:

  • modify, copy, prepare derivative works of, decompile, or reverse engineer any materials and software contained on this website;
  • remove any copyright or other proprietary notations from any materials and software on this website;
  • transfer the materials to another person or "mirror" the materials on any other server;
  • knowingly or negligently use this website or any of its associated services in a way that abuses or disrupts our networks or any other service we provide;
  • use this website or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
  • use this website or its associated services in violation of any applicable laws or regulations;
  • use this website in conjunction with sending unauthorized advertising or spam;
  • harvest, collect, or gather user data without the user's consent; or
  • use this website or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.

Intellectual Property

The Service and its content are owned by or licensed to the Company and are protected by applicable copyright and trademark law. You may use the Service for your personal, non-commercial use, subject to these Terms. You must not copy, resell, or misuse the Service or attempt to interfere with its operation.

Liability

To the maximum extent permitted by law, the Service is provided “as is” and we do not make warranties that alerts will be timely, accurate, continuous, or that availability will persist after detection.

To the maximum extent permitted by law, we exclude all other conditions, warranties, and representations not expressly set out in these Terms.

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential loss (including loss of profit, revenue, opportunity, goodwill, or data) arising out of or relating to the Service.

To the maximum extent permitted by law, our total liability to you for any claim arising out of or relating to the Service is limited to the fees you paid for the relevant purchase giving rise to the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you may have under the Australian Consumer Law or other applicable laws that cannot be excluded.

Indemnity

To the maximum extent permitted by law, you agree to indemnify the Company against reasonable losses, damages, and expenses to the extent caused by your misuse of the Service or your breach of these Terms.

Accuracy of Materials

Information on the Service (including alerts) is general and may be incomplete, out of date, or affected by third-party systems. Alerts reflect detection at a point in time and should not be relied on as a promise of availability.

Links

We have not reviewed all of the sites linked to the Service and are not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement, approval or control by us of the site. Use of any such linked site is at your own risk and we strongly advise you make your own investigations with respect to the suitability of those sites.

You may link to the Service in a way that is fair and legal, but you must not suggest any association, approval, or endorsement by us. You must not use the Service in a way that falsely suggests an affiliation with, or endorsement by, any third party (including the Universal Parties).

Right to Terminate

We may suspend or terminate your right to use the Service and terminate these Terms immediately upon written notice to you for breach, suspected abuse, or security reasons.

Entire Agreement

These Terms (together with our Privacy Policy and any additional terms shown to you at checkout) are the entire agreement between you and the Company about the Service and replace any prior discussions or agreements about the Service.

Severance

Any term of these Terms of Service which is wholly or partially void or unenforceable is severed to the extent that it is void or unenforceable. The validity of the remainder of these Terms of Service is not affected.

Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Queensland, Australia. You irrevocably submit to the exclusive jurisdiction of the courts in Queensland, Australia.

SMS/MMS Communications

The Company may send SMS communications for Service alerts and account-related notices, but only if you opt in by providing a phone number and enabling SMS alerts.

Consent to Communications

When you opt-in to receive SMS communications from the Company, you expressly consent to the Company sending you SMS messages for the purposes described in "SMS/MMS Communications". We do not charge any fees for these messages; however, message and data rates may apply, as determined by your mobile carrier.

Opting Out of SMS/MMS Communications

To stop SMS alerts, go to your account settings and disable SMS notifications. SMS alerts can only be managed in your account settings.
